Abstract

In recent years, Algeria has combined the models of a welfare state, based on public spending to provide services to its citizens, and a regulated state, open to other actors that contribute to meeting the needs of the population. The state has issued legal texts to protect public funds from waste and misappropriation, and to regulate contractual relations with economic operators involved in development efforts, seeking economic efficiency in spending and respect for the rights of these operators. In this context, laws regulating public procurement play a role, one of the main pillars of which is Law 23-12, which establishes the general rules for public procurement. Its objectives include legitimising and regulating the control of public procurement, both before and after the conclusion of contracts, from within and outside the contracting authority, in order to safeguard public funds and achieve economic efficiency and integrity.
