THE PRACTICAL CHALLENGES OF ELECTRONIC LITIGATION IN ALGERIAN LAW: BETWEEN ISSUES AND SOLUTIONS

Abstract

The Algerian legislature acknowledged electronic litigation since 2015 under Law No. 15-03, which pertains to modernizing justice and is titled "Remote Visual Trial." However, this technology was not widely implemented until the year 2020, when the COVID-19 pandemic necessitated its adoption to ensure the continuation of judicial activities. This was accomplished through Order 20-04, which amended the Criminal Procedure Law to activate this technology. Despite the efforts made by the Ministry of Justice to optimally implement the electronic litigation system, its practical implementation and widespread adoption across all judicial bodies have proven more complex than anticipated. This is due to the legislative framework's inadequacy in regulating its procedural aspects and the various systems associated with electronic litigation.
